1. Acceptance of these terms
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you use the Service on behalf of a business, you confirm that you are authorised to accept these Terms for that business, and “you” includes the business.
2. Eligibility & accounts
- You must be at least 18 years old and able to form a binding contract.
- You must provide accurate information and keep it up to date.
- You are responsible for keeping your login credentials secure and for all activity under your account. Tell us promptly at [email protected] if you suspect unauthorised access.
3. Instagram & Meta platform rules
Many features require connecting an Instagram professional account through Meta’s APIs. By connecting, you authorise bforbotz to access and act on your account as described in our Privacy Policy, only for the features you enable. You agree to comply with Instagram’s Terms of Use, Community Guidelines, and Meta’s policies that apply to messaging, commerce and automation.
bforbotz is not affiliated with, endorsed or sponsored by Meta Platforms, Inc. Meta may change or restrict its APIs at any time, which may affect the availability of some features; we are not responsible for such changes or for actions Meta takes on your account.
4. Acceptable use
You agree not to use the Service to:
- send spam, unsolicited bulk messages, or messages to people who have not interacted with you;
- mislead, impersonate others, or run scams, phishing or fraudulent sales;
- sell or promote illegal, counterfeit, or prohibited goods and services, or violate Instagram’s commerce policies;
- post or send content that is unlawful, harassing, hateful, sexually explicit involving minors, or that infringes others’ rights;
- collect or misuse other people’s personal data without a lawful basis;
- interfere with, reverse engineer, overload or attempt to gain unauthorised access to the Service; or
- resell or provide the Service to third parties without our written permission.
5. Automations & AI agent
You decide which flows, auto-replies and AI agent settings to turn on, and you are responsible for the messages sent from your account. The AI agent generates replies using your knowledge base and may occasionally be inaccurate or incomplete. You should review your knowledge base and conversations, and you are responsible for prices, promises and information given to your customers.
6. Micro Commerce & your sales
Micro Commerce lets you list products and accept orders. You are the seller of record. bforbotz is not a party to transactions between you and your customers. You are responsible for your products, pricing, descriptions, taxes, invoicing, fulfilment, delivery, returns, refunds, customer service, and for complying with consumer protection and other applicable laws. Payments are processed by third-party payment providers under their own terms.
7. Your content
You keep ownership of the content and data you upload or create in bforbotz (“Your Content”). You grant us a worldwide, non-exclusive, royalty-free licence to host, store, process, transmit and display Your Content only as needed to operate and improve the Service for you. You confirm you have the rights needed to use Your Content and to let us process it.
8. Plans & pricing
bforbotz currently offers a free plan with usage limits that we may set and change. We plan to introduce paid plans; their pricing, billing and refund terms will be shown before you subscribe, and paid features will only be charged after you choose a paid plan. We may add, change or remove features, with reasonable notice for material changes that affect you.
9. Third-party services
The Service works with third-party services such as Instagram, payment processors and AI model providers. Your use of those services is governed by their own terms, and we are not responsible for them.
10. Our intellectual property
The Service, including its software, design, and the bforbotz name and logos, belongs to us and our licensors. These Terms do not give you any rights to our trademarks or other intellectual property, other than the right to use the Service as allowed here. If you send us feedback, we may use it without obligation to you.
11. Suspension & termination
You can stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if your use creates risk or legal exposure for us or others, or if required by Meta or by law. Where reasonable, we will give notice. On termination, your right to use the Service ends and we handle your data as described in our Privacy Policy.
12. Disclaimers
The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Service will be uninterrupted or error-free, that scheduled content or messages will always be delivered, or any particular reach, engagement or sales results.
13. Limitation of liability
To the maximum extent permitted by law, bforbotz will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or INR 5,000.
14. Indemnity
You agree to indemnify and hold harmless bforbotz from claims, losses and expenses (including reasonable legal fees) arising from Your Content, your products and sales, your messages to customers, or your breach of these Terms or applicable law.
15. Governing law
These Terms are governed by the laws of India. Subject to any mandatory consumer protection rights you have, the courts at [City], India will have exclusive jurisdiction over disputes arising from these Terms or the Service.
16. Changes to these terms
We may update these Terms from time to time. We will post the updated Terms on this page and update the “Last updated” date. For material changes we will notify you by email or in the app. Continuing to use the Service after changes take effect means you accept the updated Terms.
